About Occupational License Ordinance for Mora County No. 96-01 - REVISED AND AMENDED 04-19-21

This is a summary of ordinance 96-01, which was revised and amended in section 3, paragraph b; section 5 and 6:

THE STATE OF NEW MEXICO, DURING THE 1979 SESSION OF THE LEGISLATURE REPEALED ALL STATE LAWS CONCERNING OCCUPATIONAL LICENSES, SECTION 7-22-14, NMSA 1978

 THEREFORE, THE BOARD OF COUNTY COMMISSIONERS, THE GOVERNING AGENCY OF MORA COUNTY WILL ENACT A COUNTY OCCUPATIONAL LICENSE ORDINANCE FOR ALL OCCUPATIONS, TRADES, ESTABLISHMENTS, BUSINESSES OR WHATEVER CHARACTER NOT EXEMPTED BY THIS ORDINANCE.

 SECTION (1) SHORT TITLE: This ordinance may be cited as the OCCUPATIONAL LICENSE ORDINANCE.

 SECTION (2) DEFINITIONS: As used in this ordinance:

“PERSON” – Shall mean any individual, estate, trust, receiver, cooperative association, club, corporation, company, firm, partnership, joint venture, syndicate, or other entity engaging in a business, occupation, trace, or pursuit; b.“COUNTY”…. ; c. BOARD – Shall mean the Board of County Commissioners.

d.- “PLANNING AND ZONING DIRECTOR”.- Shall mean the employee asked with running the day to day operation of the Planning and Zoning office, or his duly authorized representative; e. “OCCUPATION”.- Shall mean every person engaging in any business not exempted herein; f. “ENGAGING IN BUSINESS OR DOING BUSINESS” – Shall mean business, occupation, trade, or pursuant for the purpose of direct or indirect benefit; g. “GROSS RECEIPTS”- Shall mean the total amount of money or other consideration received from selling or from performing services by every person doing business or engaging in business in the county; h…i……

 SECTION (3) IMPOSING OF OCCUPATION LICENSE FEE:

a.- Each person engaged in any occupation in the county shall first fill out an application with the duly appointed representative for the purpose of imposing the fee due based on gross receipts and for issuing an occupational license. The first year for any new business will estimate what the gross receipts will be for that particular business and pay the fee accordingly. After that the applicant will renew his/her license each year by filling out a statement under oath concerning his/her total gross receipts. The duly appointed representative will mail a renewal notice to each person doing business in the County fifteen (15) days prior to the expiration date on the Occupational License. It is the sole responsibility of the person engaged in business in the County to have a current license. b.- Penalty for not having an occupational license will be a Five Hundred Dollar ($500.oo) fine, for every year that the business operated without a license, plus the amount of the license, depending on Gross Receipts.

 SECTION (4) RATES: The following will be the rates imposed by the Occupational License Fee Ordinance:

Gross Receipts not exceeding $10.000 - $25.00/year; $10,000 and not exceeding $20,000 - $30.00/year ……………; $400,000 and over - $650.00/year

SECTION (5) THE PLANNING AND ZONING DIRECTOR: Or his duly appointed representative is authorized and empowered to make inspections and audits of the books and related records of any person subject to the provisions of this ordinance. If a business refuses to allow this inspection to take place, they will be charged the maximum rate for every year the County is refused.
